      Hon. Austin Andrew Yates, one of the leading attorneys of Schenectady, served with the rank of Captain in the Civil War, and as Major of the Second Battalion, New York Infantry, was on duty with his command in various camps during the Spanish War, but, is better known by the title of Judge, having been elected to that office in 1873.

      He was born in Schenectady on March 24, 1836, son of the Rev. John Austin and Henrietta Maria (Cobb) Yates. The original ancestor in America was Joseph Yates, an Englishman, who emigrated in 1664 and settled in Albany. Christopher Yates, son of Joseph, and the next in this line, had a son Joseph, who was born in Albany, and settled in Glenville, N.Y., where he carried on a large plantation bordering upon the river, and owned a number of slaves. Austin A. Yates, eighty-five years old, a widely known Schenectady resident, died yesterday afternoon at his home, 1 Washington avenue, after a long Illness. Mr. Yates was a jurist, soldier and author. He had been district attorney and county judge of Schenectady county and served in two wars with forces of the United States. Mr. Yates comes from a family which has been closely identified with the history of The Capitol District. The ancestor of all the Yates in the Mohawk valley was Joseph Yates, who settled in Albany in 1564, his father William, having come to this country from England with the Duke of York. Mr. Yates was the son of the Rev. Dr. John Austin Yates, a professor at Union college from 1827 to 1849. Austin Yates was graduated from Union college with the class of 1854. After graduation he studied three years in the office of Piatt Potter, who was afterward a Justice of the supreme court. Mr. Yates was admitted to the bar when twenty-one years old. In 1862, Mr, Yates was editor of the Dally Times and afterward senior editor of the Star and Union after its consolidation. In the winter of 1863 and 1864 he commanded the troops in Carbon county, Pennsylvania, in suppressing the Grant riots and also participated in many battles in the vicinity of Washington, repelling Early's raid. t After the Civil war he was brevetted major and was appointed assistant to the judge advocate general. During the Spanish American war, Mr. Yates was major of one of the Second regiment battalions. In 1880 with Oscar H. Shannon, Mr. Yates organized Post Horsfall, Grand Army of the Republic, and was a leader in all military activities in Schenectady. Mr. Yates married Josephine Yates daughter of John I. Yates, December 18, 1865. Mrs. Yates died November 15, 1919. Mr. Yates was living with his sister, Miss Elizabeth M. Yates.
