      William Yates, by Bill Yates

      Abraham Gibson of Fauquier County, in his will dated 27 Oct 1800, bequeathed to his daughter Nancy Yates an equal share of his estate, both real and personal. He bequeathed "unto Frances Yates formerly Frances Holtzclaw, who lately Intermarried with Lewis Yates, and equal part of my estate". Frances was his granddaughter, receiving her mother's share. Lewis Yates was appointed executor, and Ann Gibson, executrix, of the will. Hugh Chinn, William Yates, and Joseph Cross were witnesses. The will was proved by the witnesses on 23 Feb 1801.

      In the accounts of Thomas Chinn, guardian of orphans of Thomas Pollard, dec'd we find: "To William Yates for a midwife for negroe Hannah". This account was returned 14 June 1785. At this date William Yates was living in the adjoining county of Fauquier.

      At the August 1790 Court in Fauquier County, on the motion of William Yates, it was ordered that Elliott McKay pay him 75 pounds of tobacco for three days attendance as a witness for him against Singleton.

      Lela Wolfe Prewitt has compiled a genealogy of many of the descendants of William Yates. In her well documented book we find the following information.

      "William and wife Nancy (Ann) were living in Fauquier County, Virginia, Parish of Leeds, when they bought from her parents, Abraham and Ann Gibson, of Fauquier for forty pounds 100 acres of land located on the head of Little River 'out of that tract said Abraham purchased of Thomas Bartlett and Martin Pickett which said Yates now lives on.' The deed was recorded in that county 25 March 1776. William Yates and wife Ann of Parish of Leeds, Fauquier County, sold this land for L150 to David Elliott, recorded 25 July 1801 in same county. Witnesses were John Bower(-n) and John Cole. It was signed William Yates and Nancy(X)Yeatts.

      "The public service claims of Fauquier County, 62-2123, show that both William Yates and his father-in-law, Abraham Gibson, furnished provisions for the Revolutionary Army in 1780.

      "William Yates Sr. and family probably left Fauquier County in 1793, as on the 22nd of November in that year Mrs. Yates' father, Abraham Gibson. . ." signed an agreement in which he stated that all his children had "removed very distant from me except Jane the wife of James Strother of the said county of Fauquier."

      "William Yates bought 100 acres of land on Otter's Creek in Harrison County, now West Virginia, from Robert and Rebecca Stewart; the deed was recorded 21 June 1802. He also purchased 39 acres on Shelby Run in Harrison County from John Hall, and it was recorded 18 October 1803. According to the deeds of Harrison County, Wm Yates Sr. deeded to both Wm Yates Jr. and John Yates 50 acres on Shelby Run and 50 acres on Otter Creek to Lewis Yates, all recorded 20 March 1819, and 50 acres on Otter Creek to Lawson Yates, 25 September 1826.

      "Virginia Tax Payers, 1782-7, shows William Yates in Fauquier County, with one poll and one slave. Land taxes of the county show he paid on 400 acres in 1783 and 100 acres after that until 1789 when his name last appears. In personal property taxes of the county, he is listed as having 5 horses and 8 cattle in 1783; 3 horses and 7 cattle in 1786; and in 1788 he is listed with James Yates. Wm Yates Sr. first appears on the personal tax lists of Harrison County in 1802 in the Reuben Davisson district, with 1 white male over 21, 0 slaves, 3 horses. Wm Yates Jr. and John Yates were on the same list; by 1805 Lewis Yates' name had been added; and in 1809, Martin Yates.

      "The 1820 census of Harrison County, Virginia, shows Wm Yates and wife as over 45, with 1 male 16-26 (son Lawson, born in 1795). Wm Yates Sr. died in Harrison County probably in early 1827, as the inventory of his estate is dated 2 March 1827, with James Sinclair administrator. The sale bill, March 3 of that year, recorded at the January term of court 1832, lists among the purchasers Lawson Yates, James Sinclair, Wm Yates and Mary Hawkins. Settlement of the estate, 18 February 1832, was recorded at the May term".

      Mrs. Prewitt continues with the next generation of the Yates family, citing the death, marriage, and tax records which prove the children of William Yates. She later studied additional tax lists, and concluded that Lewis Yates was also a son of William Yates.

      Following is the first county record generated following the death of William Yates: "On motion of James Sinclair who made oath and together with Lawson Yates his Security entered into and acknowledged a bond in the penalty of $150 Dollars conditioned according to Law certificate is granted the said James Sinclair for obtaining Letters of administration of the estate of William Yates deceased in due form of Law and it is ordered that John Wiseman, Abram Smith, Frederick Burchland, Thomas Cawthrop or any three of them being duly sworn appraise the personal estate of William Yates deceased and return an inventory to Court". Court date, 19 Feb 1827.

      William Yates was nearly a grown man, at least 18 years old, when his father moved down from Pennsylvania. It is not immediately obvious that the William Yates named in the will of Joseph Yates in 1761 was identical with the William Yates of Fauquier County, who married Nancy Gibson. Following is the essential evidence that the presumption is correct.

      First, in checking the location where William Yates bought his land in 1776, we find that the head of Little River is located within ten miles of the Loudoun County line. In fact, Little River flows in a northwesterly direction from Fauquier into Loudoun County. Thus it is not hard to believe that William Yates traveled the short distance up Little River to court and marry the daughter of Abraham Gibson. Further, we do not find the name of a William Yates in the records of Loudoun County, other than the mention in his father's will and on the list of accounts of Thomas Chinn, guardian of the orphans of Thomas Pollard, dec'd. in 1785.

      It is also significant that there was no other Yates family known to be residing in Fauquier County previous to the time when William Yates married Nancy Gibson and bought land from her father. Thus we would look to a nearby county for his relatives, and Loudoun would be the most obvious place to check.

      Second, we must consider the time factor. If William Yates was about 29 years old at the time of his first child's birth in 1766, he would have been born about 1737. That is a reasonable birth date for the William Yates, son of Joseph. William would then have been about 90 years old at the time of his death, which is an advanced age, but not beyond reason.

      Third, there is strong circumstantial evidence of a relationship between William Yates of Fauquier and the other sons of Joseph. Benjamin Yates, beyond doubt the son of Joseph, owned land and lived in Harrison Co., Va. from 1795 to 1805. William Yates left Fauquier County and settled in Harrison County during those same years.

      Fourth, there is evidence of relationships from naming patterns. William Yates named his oldest (known) son James, no doubt in honor of his grandfather, James Yates the immigrant. Isaac is a name which is prevalent among the descendants of William Yates, thus indicating that William was indeed the half-brother of Isaac Yates of Loudoun County.

      Finally, we find that William Yates, Jr., son of William Yates of Fauquier, named a son Benjamin Yates. All these facts taken together give conclusive evidence that we have William Yates of Fauquier County placed in the proper lineage.
