  1. 4.  Charles Lewis Yates was born in 1751 in Caroline, Virginia (son of George Yates, 4th and Frances Fielding Lewis); died on 13 Jul 1807 in Culpepper, Virginia.

    1757 ITEM: In Fielding Lewis's family bible is a reference to Charles Yates at the birth/christening of one of the Lewis's newborn babes. The family bible is listed in the Virginia archives library under Washington Papers. The entry is made by Fielding Lewis in 1757 and lists Charles Yates as Godfather. He is not our Charles Yates (born.1752) to George and Frances Lewis Yates but a close friend of Fieling Lewis. Charles Lewis Yates (b.1752) was Fielding Lewis nephew.

    Charles Lewis Yates, son of Captain George Yates and his wife, had attained maturity at the death of his father in 1777. If he were willed a portion of the estate of his father, he disposed of it privately, inasmuch as there are no references to his conveying land in the order books. Charles settled in Culpeper Co, VA, in abt. 1783, in the western portion which is now within the limits of Rappahannock County. He presumably followed his older brother John Yates who had already patented land along the Thornton River. He became active in the Primitive Praise House at Thornton's Gap, near Sperryville. Brother Charles Yates was listed in the first minutes of the church on 12 Jan 1788. Until his death, there are numerous references to him as delegate to the association and as moderator.

    1778 COURT: Caroline Co, VA, Order Book 1777-1780, Folio 84, May. "On motion of the said Def by William Bowles, his attorney a commission is granted him to take the deposition of Peter Dudley, Benjamin Partlow and Charles Yates de bene esse giving legal notice of the time and place appointed."

    1782 TAX: Caroline Co, VA. The land tax list showed that Charles Yates was conveyed 167 acres of land by Presley Thornton in that year, but he did not appear as land owner in 1783 or other years.

    1787 TAX: Culpeper Co, VA, 1WM>16<21, 1B>16, 2B<16, 2 horses, 2 cattle.

    1787 DEED: Culpeper Co, VA, DB O-230, 17 Dec. Charles Yates, of Culpeper Co, purchased from John Yates and Elizabeth his wife, of the same county, for a consideration of L 60 part of a tract of land formerly belonging to Nicholas Arnold.

    1792 Ibid., DB R-51, 18 Jun. Charles Yates and John Yates, of Culpeper Co, purchased from James Broadus, of the same county, for L 70 land on the branch of the south fork of the Thornton River.

    1798 DEED: Culpeper Co, VA, DB T-373, 16 Jun. Owned unimproved Lot #32 in Washington, VA, purchased from James Green, Edward Pendleton, and .....Jett, Gent.

    1798 Ibid., DB U-16, 26 Jun. Charles Yates and Mary his wife with John Yates and Elizabeth his wife, all parties being of Culpeper Co, conveyed to Benjamin Partlow, for L 50, land lying on the south fork of Thornton's Run. All four grantors signed their names. The witnesses were Jason Thomas, Thomas Jones, William Sims and Richard Yates.

    1798 Ibid., DB U-18, 17 Sep. Charles Yates and Molly his wife sold for L 50 land on......and Fork Mountain, adjoining the land of Jeremiah Strother.

    1799 Ibid., DB U-360, 5 Apr, Charles bought 110 acres in Culpeper on Fork Mountain and Thornton River from John Strother who was acting as attorney for Joseph Strother, Charles Browning and Mary his wife, William Hughes and Sarah his wife, Frances Covington and Mildred his wife "joint heirs and devisees of John Strother the Elder, decd."

    1799 Ibid., DB U-388, 18 May. Charles Yates and Molly his wife deeded to James Pinnell one half acre of land in the town of Washington on Main St., lot number 32, the witnesses were Robert Steels, James Yates, E. D. Pendleton, John Yates and David Cox.

    1802 REL: There are references to Rev. Charles Yates as moderator. Charles Yates, though apparently raised in the Anglican Church, became an active member of the Thornton's Gap Primitive Baptist Church of what became Sperryville. The minutes of the Church on 12 Jan 1788 have this notation: "In the case of Sister Mary Underwood we find by Brother Charles Yates she denies this, it is therefore dismissed." Until hisdeath there are numerous references to him as "delegate to the association", as "moderator for the meeting", and the like. On 12 Dec1789, it was agreed that the congregation would meet on the first Sunday in January "to consider whether Charles Yates shall be ordained to preach the gospel". And in 1802 there are references to the meeting with Charles Yates as moderator.

    1807 WILL: Culpeper Co, dtd 13 Jul 1807 and probated 19 Oct that year, Charles Yates named his brother, James Yates, as one of his executors and his son, Paul Yates, as another (Wills, Liber E, folio 242). Legatees were Molly, minor sons Garrett and Warner, sons Paul and Goodloe (not yet21), and daughters Frances Kennard, Polly Yates, Catherine Garrett. "In the name of God Amen. I Charles Yates of the County of Culpeper and State of Virginia being weak in body but in sound judgement and memory as usual, do make this my last will and Testament.....I lend to my loving wife Molly Yates one half the tract of land I now live on, also one Negro man named Simon and a Negro woman named Senir and my riding horse, also one bed and furniture, during her life, and after her Death the whole of the above mentioned tract of land, to be equally divided between my two sons Garriott Yates and Warner Yates and in case she should not die before they come of age they are to have the benefit of one half of the said land, until they arrive to the Age of Twenty one Years to them and their Lawful heirs forever - and it is my desire that my two Sons above mentioned be raised and schooled out of the benefit of their half of the land. I give to my two Sons Garrott Yates and Warner Yates each of them a beast and saddle worth twenty pounds also each of them a bed and furniture to them and their heirs forever. I give to my other two Sons Paul and Goodloe Yates my other tract of Land adjoining Henry Menefee and Mrs. Bryan to be equally divided between, when Goodloe Yates shall arrive to the age of twenty-one years, and Paul to have the benefit of the other half immediately. I have already given my Son Paul a beast and saddle and he is to have a bed and furniture - I give my Son Goodloe Yates my Horse Colt and a Bridle and Saddle, and in case he is not sufficient with a Saddle and Bridle to be worth twenty pounds when he gets his growth he is to have the balance in money - the above mentioned property I give to my two Sons and their Lawful heirs forever. I give to my Daughter Frances Kennard one Negro Girl named Charity one bed and furniture, etc. She is to have also one hundred Dollars in Cash and forty Dollars paid her by the first day of November next - to her and her lawful heirs forever. I give to my Daughter Catherine Garriott one Negro Girl named Letti one beast and Saddle one bed and furniture, etc., all the above property she has in possession them I give to her and her Lawful heirs forever, and that she is not to have anymore of my Estate hereafter. I give to my Daughter Polly Yates one Negro Girl named ..... one sorrel mare and saddle and bridle also one bed and furniture - also one hundred Dollars in money to her and her Lawful heirs forever. It is my desire that my Estate be wholly kept together till another crop is made, and in case it is found not to answer a good purpose in raising the above mentioned Sums of money then so much of it to be sold as will answer that purpose and the balance to be kept together by my wife to pay all my debts etc., and for her benefit - and in case there is sufficient to pay my debts etc., that Philis and her Child and her increase be left in the hands of my wife till her death - and then after that time I give Philis' Child--Increase to my four Sons. Paul, Goodloe, Garrioft and Warner Yates and Warner Yates them and their Lawful heirs forever. In case there should be any of my Estate left after the above mentioned Legacies that the remainder be equally divided between Frances Kennard, Polly Yates, Paul Yates, Goodloe Yates, Garriot Yates and Warner Yates them and their Lawful heirs forever. Lastly I constitute and ordain my loving Brother James Yates with my son Paul Yates and John Miller my whole and able Executors to their my last will and Testament Revoking all other will or wills by me made - As witness my Hand and Seal this 13th day of July1807.

    At a court held for Culpeper County the 19th day of October, 1807. This last Will and Testament of Charles Yates Decd was exhibited to the Court and proved by the Oaths of lssac Dunaway & James Bryan two of the witnesses thereto and ordered to be Recorded - and on the motion of James & Paul Yates two of the Executors therein named Certificate is granted them for obtaining a probate thereof in due form, the said James Yates having made Oath thereto and given bond and security according to Law.

    From the notes of Capt. M. Lee Minnis USN (Ret) Now a Editor for Ancestry on roots web. A highly decorated, retired naval carrier and test pilot and aeronautical engineer, began writing history after a second career as a business executive. His other widely acclaimed book is the First Virginia Regiment of Foot, 1775-1783, the first such history of any Virginia unit in the American Revolution.

    Reprint of a Family Bible in the Virginia Historical Magazine, vol 31, p.255, provided birth dates of parents and children. He resided in Bromfield Parish, Culpeper Co, VA, which in 1833 became Rappahannock Co. His name is found in the Militia of Culpeper Co in 1781. James Yates married Lucy, the daughter of John Partlow, of Spotsylvania County.

    1798 DEED: Culpeper Co, DB T-386, 16 Jun, James purchased an unimproved lot, #34, in the town of Washington, then Culpeper Co, from James Green, Edmund Pendleton and John Jeft.

    1807 WILL: Culpeper Co, WB E-242, dtd 13 Jul 1807 and probated 19 Oct that year, Charles Yates named his brother, James Yates, as one of his executors

    1810 P of A: Culpeper Co, VA, 25 Oct, John Yates had migrated to said county where he made his brother, James Yates, of same his lawful attorney to collect all money due him (Deeds, Liber HE, folio 240).James settled in Broomfield Parish (now Rappahannock Co) of Culpeper Co, where his brothers, John and Charles had settled.

    1810 CENSUS: Culpeper Co, VA, James Yates, M 45+; 3 M 16-26; 1 M 10-16; 1F 45+; 3 F 16-26; 1F 10-16; 7 slaves. Either a married daughter was living with the household or there were more children than named; 2 F16-26; 1 F 10-16.

    1810 DEED: Culpeper Co, DB EE-240, 25 Oct. John Yates, of Culpeper, appointed his friend and brother James Yates, of Culpeper, his attorney to collect all money due him.

    1823 REL: 4 May, Primitive Baptist Church, Thornton's Gap, James and Lucy Yates were dismissed by letter. James had been active there since at least 1789.

    1824 REL; Mary Elizabeth Hite, My Rappahannock Story, Richmond: Dietz Press, 1950, p. 225. James Yates was one of first 12 members of Mt. Salem Baptist Church in 1824. The brethren were James Yates, Strother McQueen, William Thornhill, John Fletcher, Elijah Bruce, and John Browning. The sisters were Lucy Yates, Lucy McQueen, Mildred Bruce, Margaret Duncan, Mary Foster, and Dorcas Duncan. The reverend was William F. Broadus.

    1828 DEATH: Family Bible listed his family and that of son Boswell P. Yates and his children (see Virginia Vital Records, Baltimore: Genealogical Publishing Co., Inc, 1984, pp. 755-756).
